Biden issues new Title IX rules

Update: The new Biden Title IX rules are getting an early application test as the Biden administration on May 6 officially opened an investigation into a Texas school district near Houston—and the parental notification aspect could be part of the analysis.

The Biden administration has issued new rules to re-interpret Title IX, particularly regarding the effective redefinition of “sex” as “gender identity.”

North Carolina passed the Parents’ Bill of Rights (SB49) last year, perhaps most notably requiring parents to be notified if a student wants to change his/her name or pronoun used at school.

School systems like Durham Public Schools have fired back, with school board discussions often touching on whether/how Title IX can be used to avoid compliance.

It’s not yet clear whether any of the new rules will materially affect the key items of SB49, like the parental notification portion. Durham inserted a Title IX “out” to parental notification in its updated policies to comply with SB49, perhaps anticipating these upcoming changes.

Prior to these new rules being released, Durham’s LGBTQIA+ Task Force has illustrated the ongoing strategizing to facially comply with the law while pushing gender ideology at every turn, as seen in these documents from the March task force meeting.

An Asheville-area LGBT group had already filed a formal Title IX complaint with the federal government over SB49, before these new rules were issued.
